The Federal Environmental Protection Agency headquarters in Washington, D.C. proposes policy and promulgates rules, while the regional offices implement U.S. EPA’s programs.
- CALIFORNIA ENVIRONMENTAL LAWS
The California Environmental Quality Act (CEQA )
The California Environmental Quality Act (CEQA) (Public Resources Code sections 21000 et seq.) is the California analog to NEPA.
Objectives of The California Environmental Quality Act (CEQA) as follows :
- Set requirements government projects and government-approved projects to be planned to avoid significant adverse environmental effects and litigious processes.
- Requires a pre approval by the State of local branch to study and prepare an Environmental Impact Report (EIR) must be prepared to identify the significant effects of a project on the environment, the alternatives to the project, and to indicate the manner in which those significant effects can be mitigated or avoided. (Pub. Res. Code § 21002.1.) If no significant environmental effects are foreseen, a “negative declaration” (Neg Dec) briefly describing the proposed project and the reasons why an EIR should not be required may be submitted.
- Designation of a Lead Agency that acts as a hybrid model when 2 or more agencies are coauthoring and implementing.
- Public notice
- The procedures include notice to the public and an opportunity for public comment. The CEQA statute and its implementing regulations, title 22 of the California Administrative Code sections 15000 et seq., provide detailed procedures for the environmental review.
- Air Pollution
- The California Air Resources Act, Health and Safety Code sections 39000 et seq., contains terms required by the federal Clean Air Act to improve and protect the state’s air quality. Statutes and objectives :
- The State Air Resources Board (ARB) is responsible for developing and promoting and preserving the state implementation plan required by the federal CAA. (Health & Safety Code § 39602.)
7. Water Pollution
- The Porter-Cologne Water Quality Control Act, California Water Code sections 13300- 13999 and Title 23 of the California Administrative Code, is parallel to the federal Clean Water Act (CWA) in that it controls discharges that affect the quality of the state’s waters.
- California Accidental Release Prevention (CalARP)
- CalARP is California’s program to implement the federal Accidental Release Prevention program (ARP) with certain additional provisions specific to California. CalARP requires businesses that handle more than a threshold quantity of any of a list of extremely hazardous substances to prepare a Risk Management Plan (RMP) in order to analyze “potential accident factors that are present and the mitigation measures that can be implemented to reduce this accident potential.”
